Your agreement with us
By visiting this site or placing an order, you agree to be bound by these Terms of Service, together with our [Returns & Refunds Policy], [Shipping Policy] and [Privacy Policy], which are incorporated here by reference.
If you do not agree to these Terms, please do not use this website.
These Terms apply to every user of the site, including browsers, customers, vendors and contributors of content. Any new features or tools added to the store are also covered by these Terms.
Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.
1. Eligibility
By agreeing to these Terms, you confirm that:
- You are at least the age of majority in your state, province or country of residence, or you are the age of majority and have consented to any minor dependant using this site under your supervision.
- You will not use our products or this site for any unlawful or unauthorised purpose.
- You will not violate any law in your jurisdiction, including copyright law.
- You will not transmit any virus, worm or code of a destructive nature.
Breach of any of these Terms results in immediate termination of your access to our Services.
2. Orders and contract formation
Placing an order is an offer to buy, not a completed contract.
- Your order is accepted, and a contract formed, only when we send you a dispatch confirmation email. An order confirmation email acknowledges receipt of your order; it is not acceptance.
- We may refuse or cancel any order at our discretion, including where an item is out of stock, a price or description was published in error, we cannot authorise payment, or we suspect fraud or resale.
- If we cancel an order after payment, we refund you in full, to your original payment method.
- We may limit or cancel quantities purchased per person, per household or per order, including orders placed under the same account, card, billing address or shipping address.
- We may limit or prohibit orders that in our judgement appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information, and to keep it up to date so we can complete your transactions and contact you.
3. Pricing, currency and taxes
- All prices are shown in The United States dollar (USD, symbol $) are subject to change without notice.
- Prices displayed can include applicable taxes, as indicated at checkout.
- Shipping charges are calculated and displayed at checkout before you pay.
- International customers: import duties, customs charges and local taxes are your responsibility and are not included in the price you pay us. These are levied by your local customs authority, not by us.
Pricing errors. If a product is listed at an incorrect price because of a typographical or system error, we reserve the right to cancel the order and refund you in full, even after order confirmation. We will notify you before doing so.
4. Products, descriptions and images
- We make every effort to display product colours and images accurately. We cannot guarantee that your screen displays colour accurately, and slight variation between the images shown and the product received is normal.
- Product dimensions and weights are approximate.
- Products may have limited quantities and are subject to return or exchange only in line with our [Returns & Refunds Policy].
- We reserve the right, but are not obliged, to limit sales of any product to any person, geographic region or jurisdiction, and to discontinue any product at any time.
- Any offer made on this site is void where prohibited by law.
5. Seasonal orders and delivery timing
Our products are seasonal. During peak periods we publish order-by cut-off dates on the website.
- Orders placed before the published cut-off are covered by our delivery guarantee, as set out in our [Shipping Policy].
- Orders placed after the cut-off will still be fulfilled, but we cannot guarantee arrival before 31 October, and late arrival on those orders is not grounds for a claim.
- Delivery estimates are estimates. We are not liable for delays caused by carriers, customs, weather or other events outside our reasonable control.
6. Discount codes and promotions
- Discount codes are for personal use, are non-transferable, and have no cash value.
- Unless stated otherwise, only one discount code may be used per order, and codes cannot be combined with other offers.
- We reserve the right to cancel orders and void discounts where a code has been obtained, shared or used in a way we consider abusive, including bulk use, resale of codes, or repeat use across multiple accounts.
- Promotions run for the period stated and may be withdrawn at any time.
7. Intellectual property
All content on this site — including the Grimhouse name and logo, product designs, photographs, illustrations, copy, video and page layouts — is owned by or licensed to us and is protected by intellectual property law.
You may not reproduce, duplicate, copy, sell, resell, scrape or exploit any part of this site or its content without our express written permission.
If you believe content on this site infringes your rights, contact support@grimhouse.shop with details and we will investigate promptly.
8. Prohibited uses
You may not use this site or its content:
- For any unlawful purpose, or to solicit others to take part in unlawful acts
- To violate any international, federal, national, provincial, state or local law or regulation
- To infringe our intellectual property rights or those of others
- To harass, abuse, insult, harm, defame, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability
- To submit false or misleading information
- To upload or transmit viruses or malicious code
- To collect or track the personal information of others
- To spam, phish, pharm, pretext, spider, crawl or scrape
- For any obscene or immoral purpose
- To interfere with or circumvent the security features of this or any related site
We may terminate your access for any of the above.
9. User submissions
If you send us comments, ideas, suggestions, reviews, photographs or other materials, whether requested or not, you agree that we may edit, copy, publish, distribute, translate and otherwise use them in any medium without restriction and without compensation.
We are under no obligation to keep submissions confidential, to pay for them, or to respond to them.
You agree that your submissions will not violate anyone's rights, will not be unlawful, abusive, defamatory or obscene, and will not contain malicious code. You may not impersonate anyone or use a false email address. You are solely responsible for anything you submit.
We may, but are not obliged to, monitor, edit or remove content we consider objectionable or in breach of these Terms.
10. Third-party tools and links
We may give you access to third-party tools that we neither monitor nor control. These are provided "as is" and "as available" without warranty of any kind. Your use of them is at your own risk, and you should review the relevant provider's terms.
Third-party links may direct you to sites not affiliated with us. We are not responsible for their content, accuracy, products or practices, and we are not liable for any loss arising from transactions made with them. Complaints about third-party products should be directed to that third party.
11. Accuracy of site information
Information on this site is provided for general information only and should not be relied on as the sole basis for a decision. Any reliance is at your own risk.
Occasionally the site may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct these and to change, update or cancel orders where information was inaccurate, including after you have submitted an order.
We have no obligation to update information on this site except as required by law.
12. Modifications to the service
Prices and products are subject to change without notice. We may modify or discontinue the Service, or any part of it, at any time without notice.
We are not liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.
13. Disclaimer of warranties and limitation of liability
We do not guarantee that your use of the Service will be uninterrupted, timely, secure or error-free, or that the results obtained from it will be accurate or reliable.
Except as expressly stated by us, the Service and all products delivered through it are provided "as is" and "as available", without representation, warranty or condition of any kind, express or implied.
To the maximum extent permitted by law, Grimhouse and its directors, officers, employees, affiliates, agents, contractors, suppliers and service providers are not liable for any indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data or replacement costs, arising from your use of the Service or any product bought through it.
Where liability cannot lawfully be excluded, our total liability is limited to the amount you paid for the product in question.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
Nothing in these Terms affects the statutory rights of consumers, including the statutory guarantee of conformity and the right of withdrawal available to consumers in the EU and EEA. Those rights apply in addition to, and are not replaced by, anything stated here.
14. Indemnification
You agree to indemnify, defend and hold harmless Grimhouse and its affiliates, officers, directors, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand, including reasonable legal fees, made by a third party arising out of your breach of these Terms or your violation of any law or the rights of a third party.
15. Force majeure
We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including carrier and postal delays, customs action, extreme weather, industrial action, power or network failure, acts of government, or restrictions on international shipping.
16. Termination
These Terms are effective unless and until terminated by either you or us.
You may terminate at any time by notifying us that you no longer wish to use our Services, or by ceasing to use the site.
If we judge that you have failed to comply with any provision of these Terms, we may terminate this agreement at any time without notice. You remain liable for all amounts due up to the date of termination.
Obligations and liabilities incurred before termination survive termination for all purposes.
17. Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed. This does not affect the validity of the remaining provisions.
18. Entire agreement
These Terms, together with the policies posted on this site, constitute the entire agreement between you and us and supersede any prior agreements or communications, whether oral or written.
Our failure to exercise or enforce any right does not constitute a waiver of that right.
Any ambiguity in these Terms will not be construed against the drafting party.
19. Governing law and disputes
If you are a consumer resident in the EU or EEA, this choice of law does not deprive you of the protection afforded by the mandatory consumer law of your country of residence, and you may bring proceedings in the courts of your own country.
